{"id":3373,"date":"2023-02-16T16:28:38","date_gmt":"2023-02-16T20:28:38","guid":{"rendered":"https:\/\/www.skypointfcu.com\/wph\/workarea\/?p=3373"},"modified":"2023-02-16T16:28:40","modified_gmt":"2023-02-16T20:28:40","slug":"how-a-business-can-give-an-applicant-with-a-record-a-fair-chance","status":"publish","type":"post","link":"https:\/\/www.skypointfcu.com\/wph\/workarea\/blog\/how-a-business-can-give-an-applicant-with-a-record-a-fair-chance\/","title":{"rendered":"How a Business Can Give an Applicant With a Record a Fair Chance"},"content":{"rendered":"\n<p>Approximately 77 million U.S. adults \u2014 more than 1 in 3 \u2014&nbsp;had a criminal record as of 2020, according to the most recent data from the National Conference of State Legislatures, a bipartisan trade association for lawmakers and legislative staff.&nbsp;<\/p>\n\n\n\n<p>That can make it difficult for these individuals to land jobs, even amid worker shortages.&nbsp;<\/p>\n\n\n\n<p>\u201cWhat\u2019s happening here is that the record itself makes employers unwilling to hire, regardless of the conduct associated with the conviction,\u201d says Han Lu, a senior staff attorney at the&nbsp;<a href=\"https:\/\/www.nelp.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">National Employment Law Project<\/a>.&nbsp;<\/p>\n\n\n\n<p>The result is business owners potentially weeding out qualified applicants, even without meaning to, because of their criminal records.<\/p>\n\n\n\n<p>Here\u2019s what you can do to make sure you\u2019re giving those candidates a fair chance.&nbsp;<\/p>\n\n\n\n<p><strong>Make your stance clear in job postings&nbsp;<\/strong><\/p>\n\n\n\n<p>Fifteen states and 22 cities and counties have passed \u201cban the box\u201d legislation that extends to private employers, according to the National Employment Law Project. And 37 states have banned the box for public-sector jobs.<\/p>\n\n\n\n<p>\u201cBan the box\u201d prohibits employers from asking about convictions or arrests on job applications.&nbsp;<\/p>\n\n\n\n<p>Lu recommends removing that question from your applications \u2014 even if you\u2019re not required to.<\/p>\n\n\n\n<p>\u201c[The box\u2019s] mere appearance is seen as a sign by an applicant with a record that they won\u2019t get the job,\u201d Lu says, adding that it may keep otherwise qualified candidates from applying.&nbsp;<\/p>\n\n\n\n<p>Beyond that, add language to your job postings that clearly invites applications from people with records. Lu\u2019s examples: \u201cWe value diverse experiences, including prior contact with the criminal legal system\u201d and \u201cPeople with records are encouraged to apply.\u201d<\/p>\n\n\n\n<p>\u201cThese sorts of things might feel superficial, but they really matter,\u201d Lu says.<\/p>\n\n\n\n<p><strong>Rethink background checks<\/strong><\/p>\n\n\n\n<p>Save background checks until after you\u2019ve extended an offer, Lu recommends. And if the background check turns up a criminal record, share a copy with the candidate and go over the results.<\/p>\n\n\n\n<p>Approach background checks with nuance. An arrest, for instance, may show up on a background check \u2014 even if the person was never convicted of or even charged with a crime. According to a 2022 study in the academic journal Science Advances, nearly half of Black men are arrested at least once before age 36. And more than half of men who\u2019ve experienced a period of unemployment have a criminal record.<\/p>\n\n\n\n<p>\u201cHow many Black men over the last 50 years have been stopped and documented in the system when they actually didn\u2019t even get convicted of anything?\u201d says Harley Blakeman, the founder of&nbsp;<a href=\"https:\/\/www.honestjobs.com\/about-honest-jobs\" target=\"_blank\" rel=\"noreferrer noopener\">Honest Jobs<\/a>, a job-seeking platform for people with criminal records. \u201cIt\u2019s extremely unfair, biased, to say, \u2018well, they had an arrest on the record.\u2019\u201d<\/p>\n\n\n\n<p>It\u2019s OK if your company\u2019s response to background checks varies, depending on what role you\u2019re hiring for, Blakeman says. For instance, you might not feel comfortable hiring someone with an identity theft conviction for a role that deals with customers\u2019 personal information. But if your team liked that candidate enough to extend an offer, perhaps they would be a fit for another opening.&nbsp;<\/p>\n\n\n\n<p>Blakeman also recommends making background checks the responsibility of one person in human resources to reduce the impact of any particular manager\u2019s bias.<\/p>\n\n\n\n<p><strong>Understand the business value<\/strong><\/p>\n\n\n\n<p>Giving people with criminal records a fair chance might help you find more job candidates in a historically tight labor market, Blakeman says.<\/p>\n\n\n\n<p>\u201cWe\u2019re not in an employers\u2019 market anymore. We\u2019re in a market where job seekers are being picky,\u201d Blakeman says. \u201cAnd that requires a different strategy.\u201d<\/p>\n\n\n\n<p>Making that shift doesn\u2019t mean compromising, though. In fact, more than 80% of business leaders said they thought workers with criminal records were just as good at their jobs as workers without them \u2014&nbsp;if not better \u2014 according to a 2021 survey from the Society for Human Resource Management.&nbsp;<\/p>\n\n\n\n<p>\u201cThis is good for people, good for community and good for organizations and employers,\u201d says Wendi Safstrom, president of the SHRM Foundation, which started an initiative encouraging employers to hire people with records in 2019.&nbsp;<\/p>\n\n\n\n<p>Another benefit: If you hire someone who has been convicted of a felony or released from prison within the last year, you may be eligible to claim the&nbsp;<a href=\"https:\/\/www.nerdwallet.com\/article\/small-business\/how-does-the-work-opportunity-tax-credit-work?utm_campaign=ct_prod&amp;utm_content=1286950&amp;utm_medium=wire&amp;utm_source=syndication&amp;utm_term=jsaenzmcefcu-org\">Work Opportunity Tax Credit<\/a>. This can be worth up to $2,400, according to the IRS.<\/p>\n\n\n\n<p>On top of this, state employment departments administer the Federal Bonding Program, which provides free&nbsp;<a href=\"https:\/\/www.nerdwallet.com\/article\/small-business\/fidelity-bond?utm_campaign=ct_prod&amp;utm_content=1286950&amp;utm_medium=wire&amp;utm_source=syndication&amp;utm_term=jsaenzmcefcu-org\">fidelity bonds<\/a>&nbsp;that protect businesses from theft or fraud by an employee with a record.&nbsp;<\/p>\n\n\n\n<p><strong>Be prepared for internal change, too<\/strong><\/p>\n\n\n\n<p>If you hire people returning from incarceration or with felony convictions, note that they may need to meet with parole officers or attend court-ordered recovery support meetings. Employees may need flexible schedules or time off to keep those commitments.<\/p>\n\n\n\n<p>Safstrom recommends connecting with a community-based organization that works with formerly incarcerated individuals.
